THE FIFTH ANNUAL SCHOOLS OF THE ROCK, BATTLE OF THE BANDS OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED.

1. HOW TO ENTER

a.These rules govern the Fifth Annual School of the Rock Battle of the Bands promotion (the “Promotion”) being conducted by CBS Radio Holdings, Inc (the “Station”) and non-profit entity Schools of the Rock, Battle of the Bands beginning on Tuesday September 6, 2011 at approximately 6:00 AM Pacific Standard Time (“PST”) and ending on Monday December 12th at approximately 11:59 PM PST.

b.To participate in the contest, you must be the band leader of an official school sanctioned high school band in the state of Washington and 18 years of age or older. You must register and submit your video via the following methods:

1.HOW TO REGISTER

You must log onto www.therocksbotb.org and follow the links and instructions to enter the contest and complete an official entry form including your school name, school division (1a, 2a, 1b, etc) band student count, band director name, email, contact phone, song name your band will be playing, artist of song, status of competition in last year’s competition (2010-2011) if applicable, and any additional comments. Only one internet entry per person and one internet entry per email address is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. For purposes of these official rules, receipt of an online registration will be solely determined when the www.rocksbotb.org web server records the registration information. Any automated computer receipt (such as one confirming delivery of email) does not constitute actual receipt of a registration form for the purposes of these official rules. The Schools of the Rock, Battle of the Bands computer is the official time keeping device for this contest. Multiple participants are not permitted to share the same email address. Use of any device to automate entry is prohibited. Station and the Schools of the Rock, Battle of the Bands are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems. All entrants must agree to the Schools of the Rock, Battle of the Bands online submission release in order to submit his or her entry.

All registration entries must be received by 11:59 PM PST Sunday September 25, 2011.

All schools that have been registered by the deadline of Friday September 16, 2011 at 11:59 PM PST have until 11:59 PM Friday October 21st to submit their video entry of their school sanctioned band’s chosen song performance.

2.HOW TO SUBMIT A VIDEO

To participate in the Promotion you must also submit one (1) copy of your video/audio performance of one (1) song in the following method from at 6:00 AM PST on Tuesday September 20, 2011 and until 12:00 AM PST on Friday October 21, 2011:

a. Upload for use online: Each band should upload their video at the Schools of the Rock, Battle of the Bands YouTube Channel http://www.youtube.com/user/SchoolsOfTheRock. In the title should be the name of the school and song being played. Included in the video description should be “Schools of the Rock Battle of the Bands 5”

b. Hard copy mail entries All mailed entries must be postmarked by October 21st to be valid. All hard copies of entries should be mailed to:

Mailed entries will be deemed made by the authorized account holder of the email address submitted at the time of registration. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address.

c. Limit one (1) entry per high school regardless of means of entry.

d. All submissions become the sole property of Station and the Schools of the Rock, Battle of the Bands (the “Contest Entities”) and will not be returned.

e. The Contest Entities are not responsible for lost, stolen, damaged, mis-delivered, mangled, incomplete or late entries or for entries not received due to difficulty accessing the internet, service outages or delays, computer difficulties or other technological glitches.

f. Each video/audio submission and each audition performed must be the original performance of the Entrant(s) and must not contain copyrighted materials or any other materials that may be restricted, prohibited or outlawed by federal, state or local laws.

g. The Contest Entities in their sole discretion, reserve the right to disqualify any audio/video submission or audition if such audio/video submission or audition contains illegal, indecent or otherwise offensive material, or if such act contains material whose content is deemed, at the sole discretion of the Contest Entities to be unsuitable for public performance or broadcast on Station (i.e. audition and audio/video submission must be radio clean.)

h. Any entries whose submissions do not comply with these rules will be disqualified.

2. ELIGIBILITY RESTRICTIONS

a.The contest is open to all official High School-Sanctioned bands in the state of Washington. The official contestant must be a band leader who is at least 18 years of age or older as of September 6, 2011 and who resides in the state of Washington. Employees of the Rock Restaurants, Comcast/Xfinity, Station, its licensee, its corporate parents, subsidiaries and affiliates, its advertising agencies, participating sponsors/promotional partners, other radio stations in the Greater Seattle, WA metropolitan area, and the members of their immediate families and/or households are ineligible to participate or win. Subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

b.Listeners are eligible to win a prize in a Promotion conducted by the Station only once every thirty (30) days and only once every six (6) months if the prize is valued over $600. Only one (1) winner per household is permitted in any Station promotion.

c.Winners will be required to provide valid government-issued photo identification and sign and return a winner release form and W-9 in order to claim a prize.

d.Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from individuals who do not meet the eligibility requirements. The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. PRIZES

a.Eleven (11) prizes will be awarded in this contest. Each prize consists of the following:
1. 4th through 7th place prize: Comcast-Xfinity will provide a pizza party. The Approximate Retail Value (“ARV”) of the prize is $750. Date, location and other specifics to be determined between The Rock Wood Fired Pizza and Spirits and the winning band directors.

2. 3rd place prize: Schools of The Rock, Battle of The Bands will provide a $1,000 check written to the 3rd place school sanctioned band program.

3. 2nd place prize: Schools of The Rock, Battle of The Bands will provide a $5,000 check written to the runner up school sanctioned band program.

4. Grand Prize: Schools of The Rock, Battle of The Bands will provide a $10,000 check written to the Grand Prize school sanctioned band program. Three Divisional Winners: CBS Radio and Schools of The Rock, Battle of The Bands will provide a $1,000 check written to each school that gets the most text votes within their division (total of three (3) $1,000 prizes)

5. KZOK will provide a $1,000 check written to the school with the best video. Voting will be determined by a panel of KZOK judges

Each winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of their prize.

b.Prizes do not represent any expectation of future employment at The Rock Restaurants and/or Station. All prizes must be picked up at the office of The Rock Restaurants, The School of the Rock, 14209 29th St. E #102 Sumner, WA 98390.

c.All prizes or prize certificates not claimed within thirty (30) days of winning will be forfeited by the winner. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. The Contest Entities are not responsible for the safe arrival of a prize or prize certificate.

d.There is no substitution, transfer or cash equivalent for prizes, except that the Station may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

a.Decisions of the Contest Entities with respect to the contest are final.

b.Each song entry meeting all eligibility and registration requirements of these official rules will be posted on www.therocksbotb.org, www.seattle.cbslocal.com and Comcast On Demand where listeners can watch the entries and listen to the songs. Between Monday, November 14, 2011 at 6:00 AM PST and Friday November 25, 2011 at 11:59PM PST any listener can text to vote for their favorite school by sending their school’s message (for example: Auburn Riverside High School could be “rock 1” and Ballard High School could be “rock 2”) to short code 24300. Specific text voting instructions will be available on www.seattle.cbslocal.com. Standard text messaging fees may apply and the Contest Entities are not responsible for any fees incurred by this method of voting.

c.The Contest Entities are not responsible for telephone service outages, delays, busy signals, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her text message.

d.Listeners may only vote one time per day per cell phone number.

e.The top ten (10) bands that receive the most votes during the voting period specified in Section 4.a of these rules will qualify for the final round of selection. In the event that there is a tie for the 10th position, then all bands that are tied with the 10th highest vote total will qualify for the final round of selection.

f.On the week of December 5th, a panel of judges will review the bands that qualified for the final round of selection. Those bands will be reviewed on a scale of 1-10 for each of the following criteria: musical effect, performance fundamentals, technical ability, and overall performance. The points from all judges will be tabulated, and the winners will be selected based on the total points awarded to each band. The band with the most points will win the grand prize. The band with the second most points will win the second place prize. The band with the third most points will win the third place prize. The band with the fourth most points will win fourth place. Ties will be broken by a straight vote by the judges.

g.The winners will be announced on-air on Station the week of December 12th. The winner will also be contacted by the Contest Entities by telephone and email.

h. Odds of winning a Qualifying Prize depend upon the number of eligible entries received by the entry deadline. Odds of a Qualifier winning the Grand Prize are 1 in 10.

i.Qualifiers do not need to listen to the Station to win. Qualifiers and the Grand Prize winner need not be present to win.

j.The winner must execute and return any required affidavit of eligibility and/or liability/publicity release within thirty (30) days of winning or prize will be forfeited and an alternate winner will not be chosen. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

5. CONDITIONS

a.Payments of all federal, state and local taxes are solely the responsibility of the winner. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other CBS Radio station in Station’s market) in a calendar year with an aggregate value of $600 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600 or more will be reported to the IRS.

b.By participating in the contest, the winner(s) agrees to have their name, voice and likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c.Prior to awarding any prize or prize certificate, the Station, in its sole discretion, may require Promotion winner (and any travel companion(s) or guest(s)) to sign a liability release, agreeing to release and hold harmless the Station, The Rock Restaurants, Xfinity, its corporate licensee, the licensee’s parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the contest.

d.If for any reason this contest cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the contest, or if the contest is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate or modify the contest. If the contest is terminated before the original end date, the Station reserves the right to select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

e.The Station, and the Schools of the Rock, Battle of the Bands, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Station’s or the Schools of the Rock, Battle of the Bands website. Failure to comply with the rules of the contest may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a contest, the Station reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law. It further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

f.The Contest Entities reserve the right to make changes in the rules of the contest, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.

g.Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of Contest Entities.

h.The Contest Entities are not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.

i.For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by December 12, 2011 to “KZOK/Battle of the Bands Contest– Official Rules,” Attn: Promotions, 1000 Dexter Ave N. Suite 100 Seattle WA 98109. For the names of the prize winners send a self-addressed stamped envelope for receipt by February 6, 2011 to the above address marked “CBS Radio/Battle of the Bands Contest – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Station and may be posted online at www.seattle.cbslocal.com.

6. PRIVACY

a.By use of the Station’s website or by entering the Promotion through the Station’s website, you agree to the website’s Terms of Use Agreement located at www.seattle.cbslocal.com and www.therocksbotb.org and to the use of your personal information as described in the Privacy Policy located at www.seattle.cbslocal.com and www.therocksbotb.org.
